Misfiring-Lemon Law

I'm thinking about trying to make GM buy my 2009 cobalt SS back.
Last week I was shifting from 1st to 2nd at 3760 RPMS and I had misfire codes:
P0300-random/multiple
P0300random/multiple
P0303-misfire cylinder 3
P0304-misfire cylinder 4

Took it to the dealership and the guy was first off a dick and didn't think that it was worth 3 hrs of labor to fix a CEL (wtf:?) anyways, they cleared it.
I read up on it and apparently this was a common issue among LNFs. It also happened 9:30 seconds after I started the car which I read you need to wait 10 minutes after startup to perform a NLS because of the stress on the engine.
Fine with me, I can live with waiting for a NLS.

Today, when shifting from 2nd to 3rd, it happened again. I'd driven back from Duluth (35 miles) and the car was warmed up significantly.
This wasn't even a No-Lift-Shift.
It threw the same P030X codes as before.

My brother is a master-tech at Toyota and said that if it happens a 3rd time they are required by law to buy it back if I have evidence(which, I do, service orders from Chevy).
Anyone think that they would fight it? Or would they take it as a lemon?
I need some advice on what to do.

No they will not buy it back, they have to try and fix it 3 times not you just having it happen three times. Also how many times has this happened, you could have already caused issues with the spark plugs or coils, also if you dont hit NLS just right it will misfire. Many people have this issue because they are mostly doing it wrong.

I went through it with my car.. I had brake problems, and then the same misfiring crap... I was tryin to get them to take it back but ended up settling right before my court date with gm.. Just stand your ground and dont give up...

I'm sure they WILL if the car is really a lemon.
It's happened twice.
I hit NLS perfectly fine the first time it did it, and the 2nd time it wasn't a NLS.

They will try and do whatever they can to not buy the car back... They dont care to have it... But if you just stick with it, its worth it... My end result i got more then what the cars worth lol

If it happens 10+ times and they keep fixing it over and over, then you might be a candidate for the lemon law. From what i've read, it will be a cold day in hell if GM buys it back.

1. you were in duluth? i did not see you....i dont believe you hahah
2. lemon law? pff far from being at all a lemon yet dude.
3. bring it to the dealer again to get it fixed...not just a clear code. I had NO idea this was "common"... if you MISS nls it will cel, had that happen to me. a restart of the car fixed that.
4. read the lemon law fine print, you do not know the lemon law..

The dealer will not FIX it because they cannot find anything wrong with it.
I will keep taking it to the dealer and I'm sure all they will do is keep clearing the code and get pissed off...

Contact a lemon law attorney.. My work where i bought the car from refused to work on it so i went above them and got the lemon law guy, and i even called and spoke to gm myself.. They were pissed but i just kept pushin

I'm not going to push it yet.
But if it continues noticely bad then I will be looking into it.
This isn't going to be my "fast car" anyways.
All that will be done to it is GMSTG1 probably and then I'll just ride out the warranty as a daily driver.
I'll get a V8 as my fast car

**** them off, and make them drive the car. there is no reason they should be gettin pissy about it anyways, it dont matter how hard you drive it, if its under warranty its under warranty and they HAVE to fix it or get you a new car.

obviously you should take it to another dealer or talk to that persons boss...then that persons boss then the regional manager. If the CEL happens its logged in the ecm and it stays lit on the dash right? if its there they have to look at it as a cel on a shift isnt normal.

are you sure you are shifting right? is this your first manual? I mean like I said I've thrown some big cel's when I missed NLS a couple times but they went away after a restart.

Nope not my first manual I've driven a WRX Impreza and my brothers '01 C5 Z06 many a time.
I thought it was pretty ridiculous that he got mad and didn't want to fix it too, but whatever..
Misfiring logs the code whether the CEL stays on or not, EX: When it misfired yesterday, the CEL flashed for about 20 seconds, then went away. It logged
P0300
P0303
P0304
The CEL is not on but the codes are there.
I'm going to wait a while, get the GMSTG1, and get to know the car better before I think about calling a lemon-lawyer.

you nls'd and it flashed then got those or standard plain easy shift? yes mine did that when I horribly missed nls. either you are lying and are ******* up shifting OR when you shift some sensor is jacked up thinking you ARE wot while you shift and arent so its cutting the ignition to do a nls but you arent shifting as fast so it f's up. Given you arent lying then yes there is a issue.

and again NO this isnt a lemon yet you havent even had it fixed once or a part replaced.... please READ the lemon law before you go about stating your car a lemon.

ouch never mind then, I have no idea on canadas emission laws/warranties. but like I said a free cat and a fuel evap cant be too expensive. see if you can install the fuel evap yourself.

well I sure to hell hope your car doesnt keep doing this. its crazy annoying having issues, believe me. My ms3 had the most retarded issues non engine/tranny related and I had to drive 2 hours 1 way to drop the damn thing off. If you were in the us it would be easier I think because of the emissions thing but I hope you get it figured out.

heres my advice. Take it in and request they open a Technical Assistance Case on the issue. This will elevate the issue. This is what dealers do when they can't solve an issue on their own.

That sucks but thanks man.

It hasn't done it recently so I'm thinking it was just a 'couple of times' or 'user error' type deal. Maybe I fucked up..maybe the car wasn't warmed up.
