Auto body Fraud?...Bs...Plz read

Ok guys thanks for reading this I need a Strait answer if I am entitiled to something here. My dad Back into the side of my car last year and Caused Damage along the Passanger side Fender and Door. My Dad went through his insurance company so we took it to a autobody shop that my father said was decent. So When we went to get a estimite the owner encouraged me to get a replacement of the door panel along with fender. He said it was in my best intrest to do so seeing I had a new car. So ok now the estimite gets wrote up for 1400 for a full replacment of both oem parts refinished down to paint. I just recently found out That the car was Repaired and not Replaced like I was told. I then thought to myself ok the autobodyshop ripped me off! So I went down there very pissed and the owner brings up the estimite on the pc and says ohh ok yeah I see the problem. ( we did a Repair on your car because the insurance company said that was good enuf. I Said Why wasent I ever notified of this change?! Not a New write up nothing! This hole time I thought I got my car fixed the way I was told. Ok now Since I picked the car up From being ( repaired ) I noticed the Door panel was Aligned wrong. The Door was prettty much ok but the black weather stripping lining was all off and I asked him Why?? His responce...Well we couldent get the door off the car it was so hard we diddent know how to? So we just left the door on. Ok does this sound like bs to you guys . Maybe when they realized they couldent get the door off they just did a repair? Also the original replacment write up was $1400 the way it should of been done? Now im no expert but isent getting a Repair Supposed to be cheaper ? The repair was $1450! in total... I thought repairs are to save the insurance company money with the hassle of ordering new parts for the car. So the responce from the auto body owner was this..Well im sorry I never told you it went from a replacment to a reapir...( umm I guess I shoulda told you )


So Now I have a messed up unevern door. Is there anything I can do? I feel Like I was screwed

Well it sounds like you have enough proof that you could go to the BBB or something like that....I'm not really sure, I've never had to deal with something like this, but i hope it turns out for the best man. It definitly sounds like you got screwed.

I don't kmow the laws in NY, but in Illinois the owner has to be notified of any changes to the original estimate This probably dosn't get done ver often, but it is the law. If you have documentation stating the panels would be replaced, I would think you would have a fraud case. Go to your insurance company and the states attorney. If you are not sattisfied with the repair, any good body shop should make it right.

I Agree that you have a vaid case here... Sounds like A Case Of BS.

Call the insurance company adjuster that looked at your car and find out if in fact it was decided by him that it should be "Repaired"

Also most insurance companies will enforce a lifetime repair garuntee. So if the repair has hosed the ride call the insurance company and let them know then ask what they intend to do to correct it. Unless of course the repair company had a problem with the location you took the car to. Then quite frankly you will be screwed.

When dealing with insurance repairs I take my car to the dealer and only the dealer. And I only want new parts on my baby!
