I have nothing to offer than my observations, which are that I turned mine upside down and it fixed the CEL immediately. Same in Joe's car. As to why that is I'd have to refer you to a fluid dynamicist.
No answer for the upside down filter trick, I accidentally came across it when I first got the filter in the first batch shipped out to everyone a couple years ago. I reported it immediately on here and sure enough someone who was curious also tried it out and saw fuel trims shift.
I have a aeroforce interceptor and thats how I noticed it. The position that everyone uses now was based off my observations of rotating the filter in different directions and seeing how it affects the fuel trim skew. Today I can still run my car on the factory tune with this intake with almost 0.0 fuel trims. +/- 2.5
The worst possible position was the one intended by K&N assuming the logos position. anywhere between 11:00 to 3:00 is where you want it. Some cars like it at 12:00, some like it at 1:00, some like it at 11:00. if you get a CEL you should try different rotations. If you have a scan guage like me that can see the trims, monitor them as you move the filter and drive some distance. Maybe you can fine tweak a good spot for your car since not all cars are exactly the same.

Word of warning though, with the K&N installed in my car stock tune my car was running EXTREMELY lean, as in the gauge on my friends tuning computer was stuck at the most lean number -25.4% the entire time I was driving. I'd suggest finding a tuner to see if your car is running lean, if it is get the fuel trims adjusted.
The filter also gets dirty as all hell and I can't quite figure out why. I've had it for 5 months or so and good god is that thing black from driving around!

I just installed my k&n sri with my forge and catless zzp dp...sounds so awesome! anyone wanting a louder blow off sound without losing any hp gain should invest in the k&n! gtn tuned next wkend with James..so excited!
I installed my SRI .. sounds amazing .. drove it for maybe 20 miles with no CEL .. positioned it at 12h30..
I don't have any tool to measure the fuel trims though .. what would I need to check those? (besides RPD)

you can get a dashhawk.. thats what one of my buddies uses.. it plugs into your OBD2 and you can pretty much get any reading you would ever want, also you can clear/read codes with it I believe

I just finished mine but used my injen(amsoil) filter with the forge bpv. What a sound. Still a little bit of surging and a little bit of a funky idle but overall a big improvement over that stupid injen...... Ohh by the way, anybody want to buy an injen intake lol.
