Auto body fraud / Insurance fraud on my 2.2 Please read

Ok Bros I have posted about this before but I have some new info on these slime ***** from a local autobody shop. My dad backed up into me about 7 months ago causing damage to the passenger side fender and Door. They Convinsed me at the shop that the Balt would need a Complete replacment of the Door Panel along with the Fender. So wrached up a estimate of $1.400 ( $140 for the fender ) ( $219 fort he door panel they never replaced, $600 for labor and like $400 for paint. I showed up finaly and he got defensive right away studdering with his every words. I handed him the estimate and told him I want my money back for the parts never orderd and labor. He comes out and looks at my car for about 30 seconds in the repaired area then looks at me with a strait face and says - ( Well It looks good dosent it ) I was like exuse me>? Argued for a few seconds and then he said well you need to come back on Monday so we can your info and what was done? Im pretty sure right there he was bying time to delete all my records? He had access to the PC that he was sitting buy right when I first walked in? THis was last friday by the way. Anyway I talked to the insurance company who handled this and they said its not our problem you need to take it up with the auto body shop. So I am demanding a check for the Door panel that was never rapleced ($219) the Labor that was never done and the new paint I will need to re fix the the door when I take the car elsewhere! I will demand $800 or I will call the BBB and Take him to small claims court

By the way the the door wasent even alined right when they took it off to just slap paint over the bondo half ass bull **** fake job they did.

Bo just be easy. If a fight starts it will give him grounds to boot you.
When you get there tell him you will call the cops and that you aren't leaving untill you get your money.

Exactly I agree 100%, They are breaking the law.
Watch how fast they change their tune when the cops get involved.

agreed, if you don't wanna shoot him in the kneecap then bringing the police, or calling them while you are there is a good idea.

Ok I just got back from there and they said they couldent get my door panel off and the insurance company made it into a repair instead of the replacement with nore the insurance company telling me or the auto bodyshop? Is somthing wrong here or is it just me!!!? I wasent even notifed about this by the shop before they went ahead and did what they did?! And the Repair Estimite I had them give me is more money for the repair ( $1480 ) aposed to the first replacment estimite of ($ 1440 ) wich I thought I had done. And they said the Door not being aligned right is becuase they had a hard time trying to get it off and it wouldent come off..My Gf says I wont stand a chance in court cus its trivial. What do I do bros?

Call a lawyer get a consult see if you have a legal leg to stand on. If they say no take your lumps and move on.

Wow...I feel for you man. I would definitely call BBB but that won't do you any good if they are not a member of the BBB. Also, I would file a police report ASAP just so everything is documented. Also, I hope everything works out for the better and that you learned NEVER to pay for anything until the job is completed. Almost all body shops deal with business this way, anyone who asks for money up front is shady.

First off if the repairs don't equal the looks of before the damage then it's not repaired & I'd call the insurance & see if they think it's good & most likly they will not like it, now they will not pay again to do it over but at least you will have a estamator chek it out & give you proof in writing that it's shotty work!

Then get the BB involved as they have done wonders for me before & then write a letter or call your attorney general as they can also help in these cases!

Please don't take this wrong BUT always deal with a shop you know & trust as I have a local shop that is awsome & he replaced my rear bumper & the lower lip & you can't tell & as I type my Son's Eclipse is having $6800 of repairs done to it from a pole jumping in front of him

Opps I forgot you want to go to another shop & get a quote to fix the work again & maybe a couple shops to see just what it would cost so you have proof that the work is bad so you can fax those to the BB & the ATN General to state your case with written proof !!!!!

Then contact a lawyer & see what he thinks as usually a $1400 law suet can cost you more to take to court than just replacing the shoty work & in that case it SUCK'S

Nick,

Just like I said in the other post, and like people have said in here, go to the Attorney-General's office. Remember, New York has Elliot Spitzer and his office has made it their top priority to go after two types of crime especially -- corporate crime and defrauding average citizens. The guy's office is like a pit bull on stuff like this -- they don't let go. I'm telling you, use his office and get these guys.

And while you won't get your money back and may pay more to get it fixed right, call Channel 2, 4, 5, 7, 9 or 11 (4, 5, and 7 have the biggest audiences) and get the consumer affairs reporters involved. If they think you've been royaly screwed, they may do a story and visit the shop. Especially since car repair is a thing EVERYONE goes through and EVERYONE is leary of.

In the end, they will air the name of the shop and tell the viewing audience (which is Southeastern CT, Rockland, Orange, Westchester, Dutchess and Sullivan Counties, Long Island, the Five Boroughs and the 13 counties of Northern NJ -- MILLIONS OF PEOPLE) that this repair shop and the guys who run it are bad news. People go out of business because of things like this. So in the end, yeah, he may have your $1400 but you'll have his ass because he'll be out of a business with lots of bills to pay and no money to pay them with!

And you'll be able to say "Who's laughing now, bitch?"
