so um yeah some bs on 460 in virginia...2 miles from the house

so this is how it started...i ran out of cigs,so i was on way to gas station like a mile up street,as i am turning in to turning lane i down shift,my exhaust does that popping sound that i think sounds great!!!! so i pull in and park get out of car and start to walk in store when i hear ...hey you come here...says the troopa....so i dunno but i just got an exhaust ticket for it last weeken on 460 virginia state troopa gave me tickets for impropper exhaust,and impropper window tint......yay,he pulled me for exhaust... i tried to say it was stock ss exhaust...worked till he got down on his hands and knees and read my muffler ....magnaflow....then my windows were all way down...he then asked me to roll the front window up.....then put meter on.....31%...50% is legal limit in Virginia.....so yeah virginia sux ass just thought i would share

I have some good news for you. You can put a theory of mine to the test. It only works for the tint though. Look up Virginia statute 46.2-1052, and read section G. It clearly explains what types of vehicles are exempt from the window tint law. It is solely my opinion, but I believe the SS/SC and SS/TC qualify as a "multipurpose passenger vehicle." Almost every vehicle qualifies under part 1 where it clearly states this law applies to all vehicles that are made to seat fewer than 10 people. Part 2 is the tricky part, and it is where SUV's and pickup trucks get away with blacked out windows. Part of it states that a multipurpose vehicle is "constructed either on a truck chassis or with special features for occasional off-road use." For part 2, you would probably need a copy of the Grand Am Series rules, which can be found here: http://media.grand-am.com/assets/KONIRules.pdf. These are the 2008 rules. You will need either 2006 or 2007. Last I checked, racing was considered "off-road" use. Because the Grand Am Series uses OE cars (with slight modification) the Cobalt SS/SC would be classified as built for "off-road use." Due to the rules, and it's architecture.

As for the specific laws you are being charged with violating, I can only help you with the tint. This is probably that law: http://leg1.state.va.us/cgi-bin/legp...+cod+46.2-1052. For the one I'm talking about that creates that loophole, refer specifically to part G. I have hashed this out with the VSP many times, specifically the sergeent in charge of the Safety Division-Motor Vehicle Inspection. Although he's the one who provided this information to me, that I am now passing on to you, he disagrees with what I have said. The good news is, he's not the prosecutor. I'd say roll the dice and see what happens with the tint. They could end up dropping both charges if they see any reasonable doubt with just one.

i have an install for the GMPP exhaust in my car, even know i have a megan on it, had the GMPP first. This gets me out of those.

2. You do not have to roll your windows up if they are down, unless they have a search warrant.

**** cops i got a 09 cobalt ss **** is bone stock no window tint and i have no front plate car has like 3,000 miles on it and i got a no front plate ticket in new york...**** was 120 bucks and i told the cop,i was like they didnt mount it i just bought it and thats how i got it and he tried 2 give me some bullshit saying the people who prep the car are supposed 2 do it.. which i work at chevy and people who do prep the car, dont mount the plates, the sale person does, but i just like **** it. Anything else i would say hes gonna have some bullshit excuse.. seems like the cops need the money from kidz 2 support there family lol. instead of getting murders and ****... i love it whens its the end of the month when have 2 show they did work,so they pull people left 2 right....when i had my srt-4 i used 2 get pullled over for stock exhaust...**** was 1 cat,2 resonators,no mufflers thats how it comes. But cop didnt believe me and i got a ticket for it.. he said 2 go to the station and see if they can sign it off... i went their 2 to get it signed off but they just laughed and said it wasnt stock...then i just said **** it and i paid for it.... I dont got time for court bullshit.i gotta was my day sittin in a court room 2 wait for my name 2 be called and when i explain my story and show proof they still gona make me pay it

bro a copdid the same **** with the tints also on my srt-4 all 4 windows down sunroof open and i get pulled over and the cop told me roll them up and i said no and he threaten me that he was gonna lock me up if i didnt.. and i laughed and i still said no and he called another cop and they wrote tickets up front my front plate being on my lip and saying it has 2 be 15 inches off the ground i got a tint ticket they were gonna give me a ticket for hids but they didnt and they told me 2 hit the gas on my car and i also said no and i got a ticket for it... no matter wat cops would be dicks and they dont give a ****... they just mad cuz when they we kidz they didnt have nice cars and also have money to throw around 2 make it looks nice.. i wanted 2 be a cop at one point but the fact i just kept gettign tickets for bullshit.. i was like if i become a cop do i really wanna become a scumbag... nahhhh

I got pulled over for my exhaust and tint in north dakota and the guy just gave me warnings. they meter said my windows were 42 and the limit is 50. The cop said he heard my exhaust over my heater and i wanted to laugh at him and say turn the radio up but i was like okay.

Wanna give me more info via PM. I can look it up in my spare time. I've done a lot of research on Virginia tint laws because I just moved here from Utah and realized that every state has different requirements. For example, Utah's limit is 50/5. Virginia is 50/35. I've decided to roll the dice to see if my theory works. To date, no cop has bothered to pull me over for my tint. I still have Utah tags on my car too. VA's law specifically says any car operated on their highways is subject to the tint law, not just cars registered in VA.

Also, if you are interested in the radar detector loophole in Virginia, please let me know via PM. This one is tried and tested by a Virginia resident, with successful results.

Depends entirely on the state laws. Most states have "probable cause" laws that allow them to make you roll up your windows. Also, the search warrant only pertains to things they cannot already see and suspect that there is probable cause. For example, cops see a bong sitting on a table in your living room while talking to you on your porch and searching for a reported marijuana dealer. That is sufficient reason to get a search warrant. Some police can have you detained at your residence until they get the warrant. Detainment is not the same as arrest. You are not arrestted until you are mirandized.

yes sir you are the man, i am gonna try it, plus i am gonna try to plead not guilty to both, i found a loop hole in exhaust, it says oem exhaust system or equal too...i am thinkin magnaflow is equal to the cobalt gmpp exaust system upgrade from gm....it is oem.......so i will let yall know how it goes i go to court june 8th so lets test these theorys

I like the fact your are standing up for your rights, and doing so intelligently, however I would guess there are some flaws in your thinking. the problem with declaring ur car as an off road vehicle, is the fact that ur are then driving an off road vehicle on a roadway. That will raise more tickets than u really want.

"You are not arrestted until you are mirandized." is a false statement. You will in fact only be mirandized when u r under arrest. however, u only need be mirrandized if the police r asking questions pertaining to a crime, to wit u are already arrested for, or already implicated in (last part is a little more in depth thatn that, but that kinda sums it up). u can get locked up and never mirrandized, its not a violation of ur rights.

also, watch urself with probable cause and search warrant needs for cars. rules change for cars due to the "carroll doctrine". carrol basically states that since cars are mobile, cops don't have to get a warrant if they can show the crime cannot be proven if the car drives away. ex: if car smells like weed, cops can immediately search car on the spot, no warrant.

I see where you are getting at, but I have to disagree. Is a bone stock Trailblazer an off road vehicle? I'd argue yes and no. However, under Virginia law it is considered a multipurpose vehicle. And that is what needs to be focused on here for the window tint. By definition, the vehicles are equipped with features from the factory for occassional off road use, and that is what matters here. Plus, I clearly stated that this is my opinion, and that the theory is untested when it comes to window tint. I'm willing to test it myself, but police officers never pull me over. I've even been followed by them for several miles too.

Contradiction? Being locked up and not mirandized is merely detainment, to which there is a limited amount of time you can be held without charges being filed and an individual being arrested (can be as much as a few days, varies per state). The sentence after my bolding should read, "However, you only need to be mirandized if the police are asking questions pertaining to a crime for which you have already been detained, or are already implicated in...." A detainment not only refers to going to jail under probable cause (without being mirandized, and no charges pressed or filed), but can be something as simple as a police officer telling you to sit on the ground while they are investigating things at the scene. Handcuffs are not always used in detainment, but often used in arrests.

Agreed. People also need to consider that once they get a drivers license most states say they can search your car with or without your consent. Again, probable cause. It doesn't take much for an officer to utilize probable cause. Your behavior could be enough to raise suspicion.

OK, I'm not sure what you do or where your pulling your knowledge from. And I mean no disrespect in any of this. but you are misinformed. Miranda is a Supreme court ruling that cannot change state to state that applies itself during questioning. you can mirandize people that aren't even under arrest. I gauruntee many people get arrested and never get mirandized. your def. of detainment is only partially correct also. this isn't really the place for me to go into it. I can agree to disagree and leave it at that.

You are correct about the Miranda Rights being a part of the constitution that does not vary state to state, to some degree. But, that is another conversation. However, I think the matter that needs to be looked at is the matter of detainment, which does vary state-to-state, but not by much.
