Will I pass Emissions in NY with the K&N SRI?

Amazon.com: K&N 69-4518TTK Performance Intake Kit: Automotive

There's a link to he product. I'm assuming that's the one to get but it says that it's illegal in states with California Emissions standards. I believe New York adopted California Emissions standards as of the 2011 model year but obviously my car is older.

Will I pass emissions in NY with the SRI because my car is a 2009?

I'm not sure how it all works.
