It is common sense. It is their money, if you have time to collect interest on their money they have every right to sue for the same interest that you made trying to STEAL their money.

This is kinda funny, and if you want to push it even further.. it COULD be considered "theft of service" lol. That is only of course if the money was never given over to the dealership, once the mistake had been discovered. And really, it doesn't take a lawyer, or anyone even almost educated- to determine that he or anyone else in his position could be held liable. Wouldn't help if he switched bank accounts. They know who they sent the check to, and have ALL of his info. even if it is the other guys insurance. =)

put yourself in somebody else's shoes. what happens to the guy responsible for failing to bill you at the dealership when they find out the money is missing and who's responsible? what if you are that guy? you werent expecting to collect off the situation in the first place, so it doesnt hurt you to give the money to the dealership. it could, and likely will, hurt somebody if you don't. It's common decency. Do what's morally right.

someone said it best in a post above, put it in a high interest saving account, make some cash in interest, WHEN not IF, WHEN they ask for it, play dumb. No harm no foul. But for **** sakes, DON'T SPEND IT!

yeah dont expect something for nothing. the way i see it , nothing in this world is free. you will be caught and it will make them angry and they will get their money, so you make the choice, earn interest on it for a whiel or turn it in.
