Not a new member, but introduction under sad circumstances

Hey guys, I think I posted in here once before but never got to post any pics. Unfortunately before I could, my SS has more than likely been totaled. Rear ended and Smashed into another vehicle. Rear ended by a loaded Silverado, and smashed into a F-250. Insurance claims the car is fixable. Cosmetic repairs totaled out to be 5800 alone, then my body man called about the actual bumpers under the covers, both broken, possible frame damage, dent on the left rear quarter with no point of impact, leading me and them to believe compression somewhere underneath causing it. I was just about to start moding too... walked away with severe whiplash, inflame shoulder with muscle bruising (not permanent, cant check for permanent damage until the swelling and inflammation goes down) Part of my spine is twisted/out of alignment, that's looking to be permanent, excruciating headaches, but no head trauma thank god, more than likely from the whiplash or unseen disk damage. Tingling in my arm. Surprisingly the rear bumper held up rather well. only broken at the very bottom, trunk is warped in a bit. A trailer hitch on the F250 caught my hood and saved me from being pushed underneath the truck, which could have resulted in a lot worse situation for myself. Im going to upload a pic of the front damages for your viewing pleasure/horror. Other guy 100% at fault.

man, you got a good nose! After I recover, weather they total the car or not, it will either be setting in a dump somewhere from being totaled, or il be trading it off for a slightly used or new (depends on how good a deal I can get new) Camaro SS

Whether it's totaled or not I'd lawyer up. Like you said, you're injured and some may be permanent.

already have. Lawyered up before I knew the extent of my injuries, thanks to the claims adjuster. Attempted to push me into a settlement less than 24hours after the accident after I spent half a night in the ER trauma. Its just ridiculous I wasn't even given fair time to recover from the shock of being in an accident, much less find out the extent of my injuries which would be expected sense they have to foot the bill. I have fair knowledge and understanding of the legal system thanks to my first couple years of college, but the injured party (me) will never be able to demand the respect that a good attorney will.

yea with them injuries I'd get what I can. My g/f's sister was in a accident and had some back and neck trauma, the person who hit them insurance is now responsible for anything that may happen in the future regarding her injuries.

it was insulting. Im not going to pursue anything astounding, just depends on my damages and medical bills, I just want to be treated fairly and compensated accordingly... push for a little extra to cover lawyer fees ofcourse.

to be honest I was most relieved when they said my knee would heal and there was no damage other than being beaten up. I love driving a manual, would die inside if I had to switch to an automatic.

sure was. Not sure on the policy limits, but the minimum is 25k, he didn't seem to be the type to have the bare minimum, but you can never tell. After the initial insult you can never rule out the insurance company causing themselves to get into a bad faith situation.

Good thing is your still alive and walked away, if the cars totaled it's only a car. Get a good lawyer who works on a percentage as they will fight hard to get you the most money possible.

my attorney is working on a contingency basis, Im hoping my spine can be fixed. Worst case scenario is treatment and pain medication for the rest of my life. Hoping for a better one.

Doing my best, ive never been in this situation before, but I want to be well prepared and I want them to know from the start a lowball wont suffice. My attorney is very experienced, he was my towns DA at one point in time years ago.

Yep, I want time to recover, while documenting my recovery and life changes day to day sense the accident. As soon as the adjuster mentioned the word settlement it was like someone slammed the brakes and threw out a roped cinderblock to stop everything. Told him I needed further medical treatment and did not want to discuss it. Hired an attorney the next day, hes dealing with them while I get checked out and healed up.

IF they do total it (which they should, obviously some frame/unibody damage) but they are trying to get out of it. That's the plan, recovery first, then pocket change. Thanks for the kind words!

Thanks for the kind words! I hope so to, the lack of sleep from the constant discomfort from my back, neck, shoulder and headaches is flat torture. Insomnia seems to be my way of life for at least the immediate future.
