Angry 09 ss/tc down

well it never fails , my bad luck is back. On my way home from work i am doing 60 ish on 161 and a stupid old guy pulls out in front of me . long story short i cram my breaks as soon as i see him but POW i still hit him. Cobalt v F350 i got the short end of the stick pic in images not sure how to put em here but check them out . 12800 in damage from a 20 mph crash. . .

Uh oh, I wouldnt depend on him getting the bill, in TX, its pretty hard to say a rear end incident isnt your fault

yea i got listed at fault becuse i wasnt maintaining a safe speed and the cop was a d*ck and impounded my car on top of the ticket

what was the speed limit?

You will most likely need a good lawyer to get out of this one.

First off you need the cop to prove you were speeding unless you admitted your speed to him.

tx law states that u must maintain at least 2 car distance. either way if u smack into somebody(rearend) ur screwed here ur at fault.

He said the guy pulled out in front of him. That's not rearending. That's the guy pulling outs fault for not judging how fast you are going.

So unless the OP was speeding, it's not his fault.

speed limit is 55 . havent talked to a lawery but i might need to the way i understood it if u hit some one in the back ur at fault regardless

That is such crap. If that were the case then the speed limit on that road is too high for the amount of traffic entering.

There are cases where it is impossible for you to predict what an idiot driver will do and them pulling out in front of you is one of them.

Take it to court. You drive a vehicle will great braking distance. Unless your reaction time was way off then it's not your fault.

Sorry to hear about the accident. But here in Alberta, no matter how it happens if you rear-end someone you are at fault, 100%. I could literally pull in front of someone, slam on my brakes and if they hit me it is their fault. It sucks, I know....but that is the way it is.

If you take it to court, I honestly feel you will be wasting your time and money. There might be the very slightest chance, but my guess is you are young and the guy driving the truck is older which will make things even harder because more then likely the judge will look at you as the "young, inexperienced driver" and the guy driving the truck as the "older, more experienced driver". Even though he did cut in front of you, I don't think you will have much of a chance.

But it is really up to you if you want to pursue it or not. Personally I wouldn't, unless you have lots of witnesses on your side or you happened to have a dash-mounted camera.

Yea but there is no way to prove he pulled out in front of him unless if he hit him at an angle and from the pics looks like it was squared up..

in texas its always like that. i have ran into someone with the same situation and they blame it on me cuz i should of paid more attention and rear end accidents always the person who hit them fault.

and if you keep the bumper. can i buy the lip off you?

Cop impounding your car is total bullshit. If he told you he was required to impound it he was LYING. I have been through that, you DO NOT have to have your car impounded, and you DO NOT have to use their wrecker (assuming you get one there first... if you dont, they can say its in the way of the road and crap.)

And to the poster who mentioned something about the driver ahead of him being at fault, that might be the letter of the law, I dont know for sure, but try proving that in court. Usually you have no witnesses except you and the other car, and what are they going to say?

But yeah, you didnt have to have your car impounded, period.
