Did you hit his rear bumper, or the side of his vehicle?

If he managed to fully come into your lane, and you hit his rear bumper, you're at fault in texas because you had ample time to see him pulling out. True, he shouldn't have pulled out anyways, but there was still plenty of time for you to avoid the wreck by braking.

If you had hit him in the side, or on one of his fenders instead of dead center on his rear bumper, you'd have a leg to stand on.

IMO, if he managed to fully enter your lane and you still made contact with his rear bumper, you were going faster than your claiming. These cars stop really great, and i've had several times to test these brakes out.

Then he failed to yield.

I don't know many cops retarded enough to give you a ticket if someone blows through a yield at an intersection. Either your embellishing your story, or the cop is retarded.

First thing my parents taught me when I learned how to drive, someone does something stupid in front of you, aim to hit them anywhere but square in the back.

I'm sorry, but i still have a hard time believing all the details are here.
How far after the yield sign did you make contact with him?
How much distance did you pass while pressing the brakes?
Around how fast were you going when the actual impact occurred?

From the way you're making it sound, all of these factors were in your favor. If so, i can't see why a cop would ignore someone running a yield sign. That's almost the equivalent of running a red light.

Any chance there is a store, traffic light camera, or such around there? Banks or any other kind of business with a camera that might be pointed in that direction?

If so, get off your ass and start asking questions before that footage is lost, and you have no basis to argue in court with.

What's the EXACT address/intersection this wreck occurred at so we can take a look through google maps and see what we're talking about here.

That sucks. Hard.

Noobish question: Don't newer vehicles have some sort of "black box" that stores data regarding accidents, etc? May have something to do with Onstar?

How would a new car be worth 10-14k? After or before accident. Insurance should cover the car cost, whatever they say its worth, a new SS I see for 18k here.

You are getting fucked by your insurance company.

Go to NADA.com, they should be paying you at least clean retail.

You should be getting between 15-16k for it.

I bought mine new for 18,250 so I'm pretty lucky that I'm not backwards on it to start with.

it doesn't really matter what the insurance company is giving him at this point, he said he has gap insurance, so its gonna be paid off either way
