Help with my tranny update 9/26 It gets more rediculous

I went to pick my car up today and they came at me with a bill for 4500.00 I told them I wasn't going to pay it because they had not given me a written estimate. They then pulled out my original signed paper in which i know for a fact had left all the boxes blank on (you know I need a written estimate, I need a written estimate if it exceeds this amount, and I do not require a written estimate) Well they checked the box I don't need a written estimate when I clearly remember leaving all things blank on the page except for my sig. They also would not let me pay with amex without signing their new invoice which stated several false things including one that they had contacted me and told me that my car was going to be around 4500.00 and that I also told them money was no object. I left the car and am going to bond it out tomorrow through the clerk and take them to court. I also contacted my local news channel and The Division of consumer services who said they didn't have a liscence on file with them. I am so pissed right now!!!!!!!!!!!!!!!!!!!!!!! They also said that they couldn't locate a whole new tranny for the car anywhere in the US which I beleive is total bullshit.

make sure you get a good lawyer, you're going to need it to fight off the signed paperwork. Even though all they did was fill in the box after you signed it.

just got off the phone with my freind who is a mechanic there and he said that he never saw me check the box and he was there for the whole thing. proof in itself! Finally something good to happen in this situation.

If it were my friend, regardless, I'd stick up for them and tell the truth. That's f***in bull**** about what they're trying to do to you. Sorry man, hope everything goes well for you in the end.

he's working on a new job anyways and court takes time to actually get to a judge so i am just going to bond my car out and shell out the 4500 to the court so i get my car back and hire a lawyer that will work on a contingant basis.

I highly doubt you could ever win this case
Every state is slightly different in this regard, but generally when you bring in your car for repairs there's a "resonable expectation" that you want it repaired in a manner that returns it to a functional drivable state. Assuming you signed the repair order (check boxes are meaningless) they need only state that you authorized the repairs (irregardless if they didnt quote a price) and as such you will be responsible to pay for what's "fair and reasonable" to make those repairs.

Pretty much ALL shops/businesses require a 2nd signature when paying with a credit card to prevent charge-backs from the credit card company
In some states/provinces though they can just put a lien against your car (making it impossible to sell) and if they didnt get paid they'd just have your car siezed in a legal fashion and sold at auction if necc in order for them to get paid for their services.
