Angry Deer Hit and Insurance Problems?!?! crap!

Ok please help me with your opinions!! and mods, please move the thread if Im in the wrong place (which I probably am)

I recently purchased a 2006 SS/SC that had 8000 miles and is still under factory warranty (as told to me by the GM dealer after checking the VIN number). 3 weeks after getting it insured, I hit a deer. The insurance company never offered any coverage that guaranteed the use of OEM parts in the repair. Now they want to replace my radiator with an aftermarket piece. Talking with my dealership, they told me it would void my warranty.

Here are my questions...

1. Do I have any recourse to demand OEM parts to restore my car to before crash condition?

2. If you hit a deer, and factory parts are used in the repair, do you still retain your factory warranty? Or is everything voided now that damage has occurred?

3. Or am I just screwed!?!

I work a the best collision and restoration shop in my area. First off what insurance co do you have? lets nope not progessive. But anyways you can request oem parts but they most likely will not use them. the only insirance co's that will use oem is state farm and american family that i know of. I just paint the cars. My boss somehow gets parts price matched in 7 years we have only used a handfull of aftermarket parts.

The womans Cavalier got hit by some drunk person who did a hit and run. We found out who it was 2 days after when we saw their totaled car a block away hidden on a side street.

The ins. company wanted to replace all the parts with aftermarket close to oem / junk yard parts.

After talking with the body shop, I said, unless every single part is OEM from GM I will not sign the check over to you guys, they went a head and ordered everything from GM except for the driver side mirror for some reason they got a used one.

I asked for all the invoices from GM and they all showed the parts arrived from Lansing MI!

I say bitch and moan until you get your way

That was cool, because it's the insurance co that decides where the parts come from. The bodyshop lost big on that one because they payed the difference not your insurance co

I have a quasi local deal grinnell mutual. I was just notified of this deal today, and I guess im pretty **** about things like this. I have deliberately kept my hands off of it until the warranty is up, and I don't really want aftermarket parts put on even if they come from the same factory in a different box..lol

I read my policy and it states that the parts must be of equal or lesser value and QUALITY? I guess I am just desperate to know if GM would warranty the vehicle, and I wanted to be able to load up my guns for a battle royal tomorrow morning! with my agent.

I doubt GM will warranty anything that was replaced whether GM or not, But like your motor/trans/all the stuff that wasent replaced you should still have warranty on

What you mean if gm will warranty your car? Aftermarket parts arent that horrible deoending on what parts they are and the tech putting them on. they usually don't fit worth a **** but if you spend some extra time hogging out holes to get a fender to line up you can do it. As for a radiator i wouldnt be too concerned.

Well I guess I should pose it like this...

Radiator is not OEM....2 days after I get the car back it somehow fails (I realize the chances are slim!). Cooks the engine. I roll it into my local GM dealership. Tech A pops the hood, sees the chinese writing on the radiator and says...WTF? We cant warranty this!..or am I looking at this all wrong.

Your looking at it all wrong dude. Relax i have never seen a tiawan radiator fail for no reason. And as for warranty if that did happen the body shop would have to take care of it. I'm assumeing your haveing your dealer's bodyshop do it?

No I'm going through an independent bodyshop. I agree with what your saying, the stuff just doesn't fail for no reason. I guess I'm just really frustrated that its not going to be replaced with OEM.

Just get it fixed. If you get it back and it's not "pre accident condition" they go their kicking and screaming. Thats the joy of insurance companys they screw ya lol you could give them thousands of dollars and not have 1accident on years they get in one ten years down the road and you still get after market parts. Just the way it is.

If your that concerned bring it up to eagle river wisconsin and i will get oem parts put on for ya.

I hear ya there, Im going to try to pitch a fit, but not a very big one!!

P.S. is that a vinyl stripe on your car or did you paint that? It looks sharp!

ya...if after a shop replaces a part it fails like that and causes the engine to blow....thats on the shop and they have to cover it, not your dealer warranty

if they noticed lol, they would probly tellyou that that part itself isnt warrantied...just like if you swap your exhaust...everything else is warrantied, but that part isnt....but that part IS warrantied by the shop that installed it (should be). in order for them to not fix something due to aftermarket parts they have to prove the aftermarket parts caused the problem

Well this is coming from an appraiser.... how bad was the deer hit?? If its close to a total then the use of aftermarket parts will lower the estimate which could save the car. If its not bad then usually OEM parts are used, but its not required. If you had a 43s endorsement that means only OEM parts are to be used, but usually you can only have that on your policy if the vehicle is under 18 months old but it varys from each company. You can firmly suggest using OEM parts and take the vehicle else where if you dont get them, but dont hold your breath cause in the end its up to the insurance company. OEM = expensive but better quality, aftermarket = cheap low quality. usually comes down to the cost.

He has a valid reason to complain though. If you wrecked your car you wouldn't want junk chineese jap crap knock offs replaced on it would you? If that happens you have a higher chance of things failing later on down the line. It's not like a week later its going to fail, but whose to say it won't fail at 60 or 70 or 80k miles when an original could have lasted 150k miles.

The insurance company is going to go with whatever is cheaper for them. I recommend you being EXTREMELY nice to them and suggesting over and over how much you want oem parts and how much the car meant to you and how long you had it, the mileage etc.

Sometimes being really nice gets you places, sometimes it gets you no where. If it gets you no where, there is really no point in flipping out because the contract you signed states that they can use whatever they choose to.

If its that big of a deal for you, just pay the difference. When I smacked a deer in my truck, I paid the difference for OEM parts. I dished out 400 extra bucks. I know it sucks paying all that money to the ins company and they hose you, but thats business. They have your money and want to retain it.

you guys talk about aftermarket parts like they are all junk. not everything that isnt made by gm is ****, i put in a lot of non oem parts and have no issues whatsoever, and a lot of the parts are high quality. yes there are the junk aftermarket parts out there, but any shop that does quality work they will stand behind wont use those parts. a perfect example is Napa new or reman alternators and starters, they are garbage, the shop i wont for wont use them cause they are junk.

biggest thing is you need is to find a shop you trust. if you have a shop that will do good quality work you dont need to worry about the use of aftermarket parts because they know what is good in the aftermarket and what should be oem.
