O2 Sensor Question

So, I've had my eye on buying a 2006 Cobalt SS Supercharged. The guy has owned it for about a year and the check engine light is on. He says he took it to a garage and they said it was the O2 sensor. He had it replaced and the same code popped back up. The garage then tells him that it's an aftermarket cold air intake that's triggering the false code. My question is, can this be the problem? I really like the car and just want to make sure that the cold air intake could cause this problem.

And if so, is there any danger to the engine in driving it with a false reading?

Thanks for any help.

It's settled, then. I'm going tomorrow to drive it again, and if everything goes good, I'll have it by Thursday. It'll feel good to be in a Cobalt again. I totaled my previous one last year. Thanks for all the help and replies!

It very well could be something simple like an aftermarket cai or a bad o2 sensor. BUT, I would never buy a car with an engine light on.... Just my $0.02

If anything, have it scanned so that you KNOW. Don't take anyone's word for gold. Once you find out take it from there if it really is the O2

Thanks for the advice. You two are right. I have a code scanner that I was considering taking with me. I think I will and do a scan to what codes read out. I would like to take it to a garage to have a technician check it out, as well. I think I'll ask the buyer to see if he has a problem with that.
