BS speeding ticket!?
so tonight i got a ticket from a police officer who "saw"me speeding while he was off duty.. he claimed i was doing 90 in a 60 zone.. i did not get pulled over at the scene.. rather, he called my mom to ask for my cell, called me, and told me he was going to be at my house in 5 mins. I meet him outside, ask what the problem is.. he tells me that he "saw" me speeding on 170th a couple hours prior, and then begins writing me a ticket.. he tells me that he couldve given me a tint ticket as well.. I laugh as i look at my car.. and point out that it is stock and COMPLETELY tintless.. but anyway, now ive got this ticket for 177$ and all i can think is "this is BULLSHIT!"
so my question is.. can cops do this??? dont they have to pull you over to issue you a speeding ticket? the cop claimed that he had up to 6 months after "seeing" me speed to issue the ticket..

yup, my mom called me up asking me why there was a cop calling her looking for me, i guess they really dont have anything better to do with their spare time.. im pretty sure this wont stand in court, at least i hope it doesnt! its like a really bad joke!
i can't see how that would stand up in court... if he was off duty, he didn't have his radar gun.. so how did he know exactly how fast you were going? don't pay the ticket, go to court and get it removed.
Take it to court, get it thrown out, then file a suit against the police department for harassment. Calling your Mom, showing up at your house hours later, not actually having pulled you over so he can't prove you were driving, saying the car had tint when it had none, etc... all add up to harassment and at the very least, if you don't get any money from it, the police chief will most likely tell the cops to leave you alone, since even after a failed case, if they mess with you again it is pretty much certain that your going to win.

Furthermore, if it went to court the judge is going to ask for proof and if he didn't use a radar gun the judge will usually dismiss it. Also if he was not on duty point out that the time of the offense and the time ticket was given isn't the same time. My neighbor is a va state trooper who tells me this stuff

Not laughin at u, laughin at the cop!! He's got nothing on u at all with out any proof and ya, no radar etc?!!!! Plus being off duty does not mean he can up and harrass people like that

Was it RCMP or Edmonton popo? And ya the tint crap.. I have 2 ex RCMP co-workers and they dont understand why have tint on the back but not on the side?? I'd much rather see through the back windows first duh..

after they drop the ticket, sue the cop for deffamation of character and falsifying government documents.

Next time that happens ask him to show you proof of your speed over. If he cant provide a speed gun showing you your speed then just laugh at him and go inside your house.
Only exception to this is if they are actually "pacing" you by matching your speed while following you and then pulling you over at the scene.
This is a ticket i actually would fight, otherwise im an advocate for paying for the speeding tickets but yeah, this sounds a bit too much bullshit on the cops part haha

DOCUMENT EVERYTHING. This guy's obviously got a screw loose and it may turn into constant harassment. I had it happen to me in one municipality and I kept records of everything that happened, which REALLY helped get rid of the problem in the end. I showed the chief the list of "run ins" I had had with various officers, never got any citations out of it, and said "Either it stops, or you've got a harassment suit on your hands." Have never been pulled over there since.
The best thing for you to do is fight the ticket. My guess is he figures you're young AND he got your mom involved, you should be an easy target who will just pay the fine, he gets a conviction, the township gets the money, all ends well on their end. Do a little research, in EVERY locality I know of an officer MUST MUST MUST present indentification and be in FULL uniform (in PA, the law used to be that if any part of the officer's uniform was missing - including their hat, he or she could not issue any tickets). If that's the case there, there's one of many strikes against this guy. Strike two is he "guessed" your speed. Officer's are trained on how to "guesstimate" speed, but very rarely are tickets based solely on that. And if he does try and make an issue out of that in court, bring up the issue of tint. This guy is supposed to be observant enough to guesstimate your speed but yet he couldn't tell that your windows weren't tinted???? Also even if he paced you, he did so in a CIVILIAN vehicle, which is NOT admissable in court. Police equipment is calibrated, including the speedometer, in order to ensure accuracy. Regular old cars are not.
