Be aware that smoked rears are not DOT legal and there have been issues with members' insurance companies refusing to pay for accidents because they had tinted tails.

Anything but reflective red is not DOT legal and anything that impedes the reflectivity of the tails is illegal whether that be tinting or "smoking".

Thats the main problem, is covering the reflective area. The actual act of tinting them is hardly illegal. As long as you just lightly smoke them, legally, you will be fine. It is not illegal to have tinted tails as long as they conform to the legal light output. Hell, they have produced vehicles with tinted tails...
