Question about accident and speed limit

Well Im sure som eof you saw my post about my accident. Saw the car today and its TRASHED! Not even worth buying back. The engine was shoved back and cocked at an angle. Blower snouth was bent and whole front end was shoved in back to where the front of the motor used to sit. It bent the frame im pretty sure because the roof buckled in the middle (so did the sides).

I didnt know how my left rear got smashed in until today though. I blacked out when I got hit and apprently after I hit him, I slid into one of those concrete barriers they use on the freeways that was sitting on the side of the road. TORE UP the left rear. Car will be totaled for sure. Only thing that survived really was the ****** park bench wing and parts of the interior. 3/4 wheels are bent.

The question I have now is this. The street I was on is I guess "technically" a 25mph zone. But heres the thing. Going NORTH, the speed limit drops to 25mph. However, going SOUTH the last speed limit sign is 45mph, it never has a 25mph speed sign. I was going SOUTH, so will they try to say I was speeding? I was doing about 40 mph when I hit him.

I dont think itll matter. He doesnt have insurance so my UIM/UM coverage will pick it up.

The last posted speed limit is what you are supposed to abide by. You can't be expected to be goping 25 MPH if the last sign on the road was a 40 MPH.

And didn't you get hit by a drunk driver? You really won't be at fault at all, so there's no reason they would be investigating you. Watch out! Grissom might come out there and do some crazy forensic thing

Nah, the guy wasnt drunk, he was just a moron from the Hot Import Nights car show. The other yellow SS/SC in vegas was hit by a drunk driver.

This guy just backed into the street as I was coming down it. Nothing I could do I tried to veer left but didnt have enough time to get out of his way.

I wasnt at fault, he was and go tthe tickets.

The data in the "black box" of the car is the property of those who have title to the vehicle...

If you still have title, and you have not signed it over, you can remove the computer...I'm not sure where the "flight recorder" is in the Cobalt...you might want to find out...

I already signed it over today. Im not worried about it, I know how fast I was going and admit it was about 40 mph. My car is covered either way. The guy didnt have insurance and was at fault. IF there was a 25 mph limit sign, and I was going 25, he still would have been at fault. I wouldnt have had time to stop from 25 mph. But there wasnt a 25 mph sign and they can check that (I just did earlier before this post).

Im thinking about another cobalt. If I cant find one I like, Ill probably pick up a Silverado single cab short bed used. I dunno yet, too early for me. Gotta go look and get some prices.

Did you read any of this post? I mean seriously. If I have to obey the posted speed limit (which is what Ive always known, just wanted to make sure), it was posted @ 45mph. The OPPOSITE traffic was posted at 25mph. I was going 40 mph.

Yeah you should be fine with it, but I have a proposition for you. I just fucked up one of my rims and you said that 3 of the 4 were bad, would it be possible for me to buy the final good one of it.

If I couldve gotten it I would have gamebay sorry. I tried to get it at the tow-yard today but the ONLY thing I got was the floor mats. They wouldnt let me take anything else, not even a wheel

I was going to buy it back and part it out, but seeing as the engine is probably toast, the S/C snout is bent, and none of the suspension/body is in any condition to sell, I wont be getting it now

Sorry!

I wouldnt really worry about it, as long as he was rulled at fault and got the tickets. They can't give you a ticket now anyway. It was the action of the other guy that caused the wreck so it dosent matter. Trust me I am going through the same thing right now and have a very good atorney. The guy that hit me had insurance though, but your insurance company should not raise your rates since its not your fault. They will go after the other guy for the money, probaly put some sort of judgement against him and even cause his license to be suspended for a while. Keep looking for another balt, I was looking at fullsize trucks to but man they chug the gas.

You bastard. Did you pick up the orange SS/SC with the stage 2 kit from Henderson Chevy?!!!

LOL I was at fairway the other day and it was there, someone had bought it I think (or something). I almost bought that one, but my wife didnt like the color so I picked up the yellow one.

Congrats anyways on the new car

Yeah dude you could have been speeding and it wouldn't matter. He pulled out in front of you and took your right of way causing the accident. Besides these guys are right the last speed limit sign on a road is what you go by.

You'll be fine man don't worry.

Who is "they" that would say you were speeding? The police would have ticketed you at the scene of the accident right away. Insurance companies can only use whats in the police report and the adjuster report.

Yeah, was going to go, but got tied up with work stuff. I swung by the in and out but it was after 9pm. There were a few people there, but not a whole lot. I just ate something real quick and left. Wanted to hang out, but back was hurting and needed some of the meds the doctor gave me so I went home. Hopely next week I can get there in time.
