Your insurance should cover it, then go after her to get their money back (Ex. taking her to court or her insurance co. to court)

yea the only thing is mr. is that the deductable comes out of my pocket when my insurance covers it. because if we cant find out she doesnt have insurance thats whats going to end up happening, unless i can sue her. which should be a win win hands down cause i did have my camera in my glove box (on the way to street race in philly) so i took pics of all her **** on the high way her car my damage. so i should be covered. i got it on down

a couple of years ago, i had a 96 Cavalier with full coverage on it. I was following a quarry truck that belonged to a concrete company over in Vermont... i was back about 4 car lengths, going about 60 when the truck crossed a rail overpass. He hit the seams in the overpass and rocks the size of softballs come flying off the truck! GAH!!!!! I jump up on the brakes, but not before a rocks smashes my headlight covers, bends the headlight bracket, and then smashes the windshield... more like punched a hole in it! The rock ended up on the front seat of the car. I still have it on a shelf here.

So I had the plate number of the trailer and call the cops. Sorry, here in NY, vehicles aren't responsible for items kicked up. I told the brainless trooper on the other end that it didn't get kicked up, it fell off of a trailer. His reply: Can you prove it? I'm holding the ************ in my hands, barney fife! Still nothing we can do. have a nice day. I called the company who the semi belonged to and they told me to **** in my hat. They weren't paying for ****! (exact words)
So I was stuck for the cover and headlight, but the insurance replaced the windshield.
doesn't it always seem like you're the one getting fucked over?

So cops wrote up the police report and she got a ticket for failer to control items on her vehicle.

Anyways 2 days ago i went to get my damage appraised and it came to 1,100 bucks.. So i was like wow whever shes gonna pay for it. Well my insurance agent gets back to me, and says the girl keeps tellin him she wont tell him who she has and its not her fault that i ran into stuff on the road. WTF!!! WHAT A The insurance guy said there is a 80% chance she doesn't have insurance at all. which means im Wow.. rediculous. So now I have to fix my on my own and not get paid. ill prolly end up going to court once they figure out if she has or doesnt have insurance. but rediculous. if there is anyone out there to help me out with some parts. My car is the rally yellow SS/NA..

Thanks guys... this just sucks when i just got the damn thing... argh

Just because she does not have insurance does not mean jack. Your insurance should still cover everything with only a deductable. Then your insurance will go after her for the deductable and you will get it paid back. I been through this before and you need to kick it in high gear. Don't get fucked over bro. Trust me. We pay higher rates because of people not having insurance thats why they cover you when something likes this happens.

wow that sure sucks.

atleast insurance doesn't work like that here, it's always YOUR company that pays for your damages, so you're sure to get paid!

yea i understand that, as of right now the damage was like 1,100 and i got less that 600.. they took my $500 deductable. however once i get my car fixed i am still shafted. she said she is not paying a dime of the 500 deductable. so in my case.. they are sending it to the collection agency, but she can still fight it. which means ill be on judge judy.. "she can knock it out in 30 mins plus commercials"
