So yesterday I was just getting ready to study for my calc test when my mom came in and handed me an envelope from the City of Tempe Police Dept. I was like wtf? Apparently I got flashed for speeding on 500 S. Rural Rd. Honestly, I thought the speed limit there was 45,but what do you know, it's actually 35. I live in mesa and every 6 lane road has a 45 mph speed limit. It disgusts me that they would place one there knowing that a lot of students drive past there. I'm poor as it is (trying to save money for school) and they want me to shell our almost $200. The fine is $171 and iI think that's bull ****, especially because the Arizona Supreme Court mandated that the maximum fine for a photo radar ticket is $165. Would it be better to just pay it or wait for them physically come and serve me?

Well I've done some research and the Arizona State Law says that if I do not send back the waiver admitting that I received it, I must be physically served by someone appointed by the court.
DO NOT MAIL THE CITATION BACK, YOU MUST BE PHYSICALLY SERVED
Arizona Rules of Civil Procedure:
Rule 4.1(d)
Service of Summons Upon Individuals. Service upon an individual from whom a waiver has not been obtained and filed, other than those specified in paragraphs (e), (f) and (g) of this Rule 4.1, shall be effected by delivering a copy of the summons and of the pleading to that individual personally or by leaving copies thereof at that individual's dwelling house or usual place of abode with some person of suitable age and discretion then residing therein or by delivering a copy of the summons and of the pleading to an agent authorized by appointment or by law to receive service of process.

It sucks cause i just got one for turning right at a red light! I have to pay $248.47 for it! But they are allowed to send it in the mail! They do not have to give it to you in person! If you decided to ignor it, they can charge you for sending someone to your house, and then youll have to pay more! this is what i found. Its a little long...Sorry!
_(2) An individual, governmental entity, corporation, partnership or unincorporated association that is subject to service under paragraph (d), (h), (i) or (k) of this Rule 4.1 and that receives notice of an action in the manner provided in this paragraph has a duty to avoid unnecessary costs of serving the summons. To avoid costs, the plaintiff may notify such a defendant of the commencement of the action and request that the defendant waive service of a summons. The notice and request:
(A) shall be in writing and shall be addressed directly to the defendant in accordance with paragraph (d), (h), (i) or (k) of this Rule 4.1, as applicable;
(B) shall be dispatched through first-class mail or other reliable means;
-D) shall inform the defendant, by means of a text prescribed in an official form promulgated pursuant to Rule 84, of the consequences of compliance and of a failure to comply with the request;
(E) shall set forth the date on which the request is sent;
(F) shall allow the defendant a reasonable time to return the waiver, which shall be at least 30 days from the date on which the request is sent; and
(G) shall provide the defendant with an extra copy of the notice and request, as well as a prepaid means of compliance in writing.
***If a defendant fails to comply with a request for waiver made by a plaintiff located within the United States, the court shall impose the costs subsequently incurred in effecting service on the defendant unless good cause for the failure be shown.

all the newer ones are getting speeders, i got one going through an intersection in Tempe for speeding, they do right turn red lights to. you have to stop for like 3 seconds

Sorry but it's still a summons, and must be served in person. Just like if the judge asks you who's in the photo if it's not you? that's black mail. Cover your face, if it's obvious they can't identify you they are required to toss it out.

if you live with anyone else please don't ignore that ****...trust me someone else will open the door, take that **** and you will be officially served lol. happened to my friend...
i'm just gonna pay this bullshit...the fucked up part about mine is that it was like 12AM and I was on the way to a club. didn't even know the **** was there!

haha look at all you losers.... i NEVER speed through Tempe, doesnt matter what part of the city, cuz they have cameras up the ying yang... eff that, im only 20 yrs old, i dont want my insurance to jump cuz of some lousy tickets that could be easily avoided...
besides, why are u guys speeding in the first place? traffic off of University and Rural is always busy..

haha look at all you losers.... i NEVER speed through Tempe, doesnt matter what part of the city, cuz they have cameras up the ying yang... eff that, im only 20 yrs old, i dont want my insurance to jump cuz of some lousy tickets that could be easily avoided...

theres no traffic at 12AM going to the club, I was the only car on the road besides another...I went to pass because they were moving at turtle speed and BAM
never even saw it coming
besides that street is only like a 35?mph road, wtf?
