$10k in damage is like half the price of the car... not to mention that kbb for them now is like $17k or so.

That's gone.

Damage has to exceed 80% of the value, so that'd be somewhere around $12-14k in damage and that's easily that much.

Although you DROVE it home? That's insane!!!!! How did it drive? Any problems? If you avoided frame damage, you MIGHT be able to squeak in under 80% of value in damages, but I really really doubt it.

For comparison:

JUST that was almost $7k.........

my 96 chevy lumina was t boned by an suv (the lady told the cops she fell asleep behind the wheel since she was on video and everything running the red light) at 50 and i barely had too much damage to it, spun me in a 360 and i kept it under control and stopped on the other side of the intersection in my lane. my frame wasn't damaged at all and my car just had some body work but they totalled it from just body damage, didn't even have an air bag go. they totaled the brand new suv though cuz my car ripped the front end off lol but it sucked cuz i loved that car as my frist car, great shape and low mileage from my parents who were the only owners of it. i drove it home right after it happened and there was nothing different about how it ran/drove or anything, just some body damage that wasn't even too bad. it's amazing how much the cars can take from an impact like that and they didn't give me jack **** for the insurance money for it....... the tranny was just replaced cuz i beat on it a lot and it was 2 grand and they gave me $35 more for it even though it had no damage from the accident, they got $1500 for it after they sold it... hopefully you'll get somethin reasonable out of it but by the looks of it you probably had some damage to the frame which is a 100% chance of it being totalled. hopefully it works out for ya though, sorry for the loss

In either case... if they don't total it you need to sue the driver that hit you for damages. A hit that bad will go on your vehicle history... even if it's repaired back to factory specs. You'll never be able to resell that car or trade it in on anything with damage like that on your carfax report.

Most definetly .... Get a Lawyer...
I got hit in 02, car damaged similar, came out of it with $60k after medical and lawyer.

I plan on replacing with a trailblazer... it all depends on what happens with the insurance. I owe more then what the car is worth so im guessing between the insurance company and the gap insurance itll pay the car off and i wont have anything to put towards a down payment. if they give me money for the medical and such then ill use that as the down payment. I can pick up an srt4 from my buddy for 10g, but it has a salvage title. i know it runs good and hes modded it some... but ill see... the ms3 doesnt look bad either. All i know is it WILL NOT be another cobalt. not sc, not turboed, none!

Trailblazer SS would be sweet! Yeah, I would sue to make up the difference. Why the hell should you pay for the car when you didn't cause the crash. Actually their insurance should pay the thing off?! Not sure. If not I would sue though. **** paying off that totaled car.

i had a similar accident but mine hit the tire and stuff.. i was going through a greena nd lady went straight through her stop sign and t-boned me..had to replace all rear suspension etc and rear quarterpanel and whole door..cost 12k$ so don't think urs is gonna be totaled (mine was same side as urs too) on the other hand i only needed another like 2 or 4 grand and it woulda been gone so MAYBE urs might be..if u got frame damage then eya its gone..

well heres the damage i can see that the pictures dont show.... the trunk needs to be replaced, the rear bumper needs to be replaced, the roof of the car is buckled enough to push the sunroof out of its spot, both passenger side airbags went off, pretty much the whole passenger side needs to be replaced. the backseat, and front passenger seat need to be replaced, im assuming my gas tank is bent, so itll probably need to be replaced and you all can see the rest.

ITS TOTALED!!!

There is tremendous body damage not to mention all of the broken parts to replace.
