The vehicle code doesn't directly say aftermarket parts. For example: If you have an intake w/o a carb number, the cop may write you up for "equipment for modified use" or "modified emission devices." The vehicle code, like any law book, uses the english language in a general sense to be able to cover a broad spectrum of categories for the peace officer to use. I do believe there's some codes regarding intakes and headers themselves, the rest generally will go under the ones mentioned above. Like i've said, best would be to read or simply ask your local PD. If the officer wants, he could cite you just to give you a hard time. Most won't though considering you only visiting and your vehicle is legal within YOUR state's vehicle code. All at the discretion of the officer.

All they need is probable cause to pop your hood. Most people think they need a warrant to do so, but that's just a myth. I may be mistaken for other states, but in Cali, if the cop has probable cause to think your vehicle is modified, he can ask to pop your hood. Part of the academy instructs officers on what to look for under the hood. And some cops know cars pretty well. My old car was turbocharged, and after seeing the exhaust and intercooler in the front, he had me pop the hood and wrote me up. Easiest way to get probable cause, modified exhaust.
