That sucks

What has worked for me in the past is to show up at court, admit you were wrong and be willing to pay the fine but ask for no points because you need a clean driving record for work.

Good luck

Cop was a *****. "What's YELLOW mean?"

"Slow down," says I.

"Why didn't you?"

"Cause I didn't want to slam on my brakes." Didn't say anything else.

Fine's $107. I just don't want the damn points....2 of em. Figure I'll send in the check, plead not guilty, cancel my court date afternoon before, morning of. Reschedule, and hope the cop doesn't show
I got a failure to obey a posted sign or signal and it was no points, but that's because he gave me a break since he was really pulling me over for doing 84 in a 55.

Don't cancel that close to the court date, they don't have to give you a continuance. I believe you have to make the request either 7 or 14 days in advance.

^^^^Best way to handle it. Even when I've had ***** ass cops and bogus tickets this has worked. All they want is a conviction, all you want is to keep points off your license. Everybody wins.

another way of fighting this is simple. your word vs his. You say yellow, he says red.

Everytime I've seen this when waiting for my turn in court, they favor the defendant.

LOL, I wanna have your District Justices in my area!!!!!!!!!

Everytime I've been in court it's been the opposite. They'll take the cop's word over anything else. Last bitch I had to go before was too busy inviting the cop and his family to her house for Thanksgiving (seriously...she was giving him directions to her house while I'm standing there waiting for my hearing to start) to pay any attention to anything else. She only grudgingly let the two defendants before me get a word in after the cops gave their stories before finding them guilty.

His word against yours? I am pretty sure in a lot of cases they would believe a cop. They take oaths and such...

"innocent until proven guilty"

interesting because ive seen that method done 3x before when waiting for my traffic ticket case.

burden of proof is on them, and honestly, a red light ticket is one of the most difficult to prove.

OK, so you've seen it done 3 times, but what did you use then if that defense works so well?

Gather as much information as possible. Pics of the intersection, of where the guy was coming from. Best argument would be that you were x feet away from the intersection when the light turned yellow. Given the speed limit of x mph, in order to stop for the yellow light you would have had to put the brake pedal to the floor, which would cause the car to skid to a stop and would ultimately be more dangerous than to proceed with caution through the yellow light.

Take everything you can with you to court. Briefcase, laptop, enlarged photos, everything.

Basically it's just a mind game till you actually get in front of the judge. The day I went in, they were just bringing people in and finding everyone guilty. My case was the only one that the officer even asked the judge to make a deal with. You need to make them think that you've got solid proof they're wrong. Even if you don't, keep up appearances. Remember, all they want is a conviction, so if you can make them think you stand a good shot at an acquittal, they'll be a lot more willing to deal.

I've never been caught running a redlight, mainly all speeding.

Which ive used misc defenses, win some lose some. Typically when i lost, I just appealled it, took it downtown, and pled guilty to 5 over $35 fine

I never fight tickets. I just pay them and see it as a way of donating to communities... I can lie to myself if I want.

Yeah but then you get fucked royally when it comes to insurance. If there's no points involved, I'll usually just pay it and be done with it. If there's points, you better believe I'm gonna fight it.

Yeah, I had that one ticket for failure to obey the posted limit or whatever... it was $107 with no points. I paid it and didn't ask questions. No points, no problem.

How can you tell if the citation actually has points? Nothing I can see on the ticket itself. Looking it up it says 2 pts, but I dunno. He didn't even write what I did

first i got onto the turnpike at new stanton, and got pulled over before irwin for doing 81 in a 65. then traffic was backed up at churchill until the tubes. and then after i got off at the 3B exit i took the first left and that took me past the hospital back to the parkway. in the end, after going thru downtown, i ended getting there ten minutes late but i did find i nice little place to park the bike behind thaw hall. after that the ride to cal sucked. its just going to be a long semster. pitts fine, but the drive sucks.
