Exclamation intake issue

so i'm new to the cobalt realm and i just bought my 09 SS used, with about 8k miles on it. well, at the dealer i was told it was all stock but noticed the intake looked aftermarket. its and AEM intake. sometimes when driving there is no get up and go and there is a lot of lag between acceleration, but its not all the time...i just attributed this to being a 4 cylinder turbo (no offense, but i'm use to the ls1 get up and go). well today when driving home my check engine light comes on and i'm wondering what it could be, its a brand new car. i contact onstar and they run the diagnostics....issue with the air intake system and i can drive it but the car may be sluggish and they recommend me taking it in for service as soon as possible..

since the first owner put the intake on..i guess wrong.. does that void my warranty? this is suppose to be my DD, i didn't want to mod it at all

any issues about AEM intakes i should know about. i've done work on my camaro and so i can make my way around an engine bay but this intake tubing goes down so i don't know where to look for an issue.

thanks for the help guys

just fyi - i did read the sticky, but i am worried about the car being sluggish..is that the code just causing that issues and i once its cleared i won't have the slow acceleration and boost issues or is it beyond the code that even if i get it cleared something may have gone wrong with the intake system

Aems come with a dry filter(no Oil)I think, if thats the case change it to a oiled one or get a cover for it.
If it gets wet or even damp it will restrict air flow and cause the car to run sluggish.

Also check all the piping for anything that looks like a leak.

Is it just outright slow, or is there almost a surging? When I got my 09' SS Brand new it had a surging problem for around 6-7k miles and noone could figure it out to the point I was pursuing lemon law, when suddenly the car fixed itself. I only had the problem 1 other time that was about 6 months after that and it only did it for a day, no idea what the problem was. I now have added bolt-ons and have yet to have any other issues.
