His car was just running like crap, tons of popping cels and tons black smoke coming out of the exhaust whether he was cruising or getting on it. Dealership though they fixed it but didn't so now it's at the dealership for the 3rd time. So rage decided to just declare the lemon clause and not have to deal with these problems anymore.

I think that is 100% bullshit. You tune the car and it gets messed up...and you think its the dealerships problem? HOW? Even if they turned it back to stock some damage could have been done that they could not just fix with a reflash.
I think the lemon clause goes right out the window when you mod your car like this. Sorry bud. You should suck it up and fix your own damn car. If you cant afford to fix it then you should not have bought it....or ever modded it.

Though I tend to agree with you, there are also certain, underlying problems that would not be caused by a tune. All of the problems caused by a tune would be rather easily discovered, and fixed. I don't remember which CEL's he had, but I think they were the misfire CEL's. That has nothing to do with a tune.

first off you need to shut the **** up and ask for the rest of the story, i have had issues before i modded and tuned the car, total of 8 times for the same ****. problems as early as 2200 mi. explain that? yea modding the car might have fuked it up more but proof is on paper that dealer printed out. 8 time dealer same issue no fix = LEMON **** you bro!
