Code P1174 - No CEL, why?

Code P1174 - No CEL, why?
A few weeks ago, my car threw on the CEL and I pulled the code: P1174. I thought maybe it was just an ancient code from some crappy gas I put in a few weeks ago, so I cleared the code and went on my way.
A week ago I pulled the codes again, and the code is back but there's no CEL. Why would it do that? My dealer has said it likely will not be covered under power train warranty (if the failing part is even eligible) because it isn't turning the light on. They say no light means nothing is broken.
So why would it throw a code and not turn the CEL on? Should I expect the dealer to look at this for free as the code seems to be related to power train related parts? I'm out of comprehensive warranty now. Should I go demand they do the TSB for this code, free? Fuel injectors are part of the powertrain warranty after all...

Its not going to throw the code till it has the problem consecutivley what ever the set number is like 2 or 3 times in a row then it will throw a cel. If its a random problem it might go weeks or months before it throws a light.

I really had to push the dealer, but they're replacing the injectors tomororow. At first they refused to even look at it for free, again quoting "No CEL, no inspection, period." But I was expecting this so I printed off the TSB and pushed them hard. They finally caved and sure enough I have the problem precisely what the TSB stated.
Dealers are such ******, but at least it's getting fixed. Too bad I had to pay $35/each for 2 new center caps... bastards
