After cat o2 sensor location.

Hello everyone
New here and I'm hoping you guys could take a look at the two attached pictures and point me in the right direction.
I started getting codes for a secondary o2 sensor fault so I climbed under the car to make sure I didn't have any loose or broken wires and that's where the previous owner mounted the sensor when they changed the exhaust system
It seems to me I'd want the sensor in the direct flow of the exhaust and not over to the side where it is.

that angled spacer is supposed to prevent any after-cat cel because of the pipe not having a catalytic converter (catless)

Thank you.
I'm still learning about all this stuff and apparently I don't know enough yet to search properly.
All the mods to the car were done by a po so as things come up I'm having to first verify that what they said they did is true and then whether they did them correctly.
