im still waiting to see if anyone got a pic of the rcmp officer parked next to us backwards like we were. that will put a damper in their retaliation if any

difference was that that area is technically a parking lot so hes not in the wrong but the RCMP that pulled up packed the exact same area as us and in the same position.

Here's my letter

To Whom It May Concern:

Subject: Sylvan Car meet ruined and drivers harassed / profiled by local officials.

Please find this letter in regards to the recent actions of one Cst. Dave Kyllio of the Municipal Enforcement department of Sylvan Lake - Badge number 11671.

On Sunday August 12, 2007, several fellow members of the North American forum Cobaltss.net arrived in Sylvan Lake for a morning meet; the purposes of this meet was to show off our cars as well as take several pictures in effort to organize a future meet in spring of 2008 consisting of Western Canadian and potentially some US members. Upon arriving to the township we quickly washed our cars and proceeded to the main drag where we parked the cars facing Sylvan lake and the main street. We proceeded to visit the local businesses and an hour later returned to the cars to find Cst. Kyllio writing tickets.

As I was ahead of the others I ran ahead to inquire what the citation was for. Upon approaching the officer I was instantly told “Don’t even think about moving your cars, they’re all getting tickets and will be towed” I attempted to ask the officer why we were receiving the citations and was told greeted with another off hand flippant comment. At this point the officer observed the group of owners approaching from behind me and immediately radioed for backup and the RCMP support.

Both in my own and fellow members opinions this was completely unwarranted and an uncalled for action since none of us approached the officer in any manner that could have been misconstrued as offensive or threatening. We remained at a safe distance and continued to try to approach him in a civil and open manner, we can understand if in fact Cst. Kyllio felt threatened by 6 males and 2 females however again I stress that we maintained a safe distance, made no threatening actions and maintained a civil tone during the confrontation.

After calling for his backup several other members asked the officer what the infractions were for and again received similar treatment and uncalled for rudeness. It was at this time that the constable informed us the tint on the cars were also illegal and that we either had to immediately peel the tint off or have the cars impounded and towed back to our respective cities and held in the impound lots, in addition to receiving a 150 dollar fine for the tint. Again the officer would not clarify why this was taking place nor answer our questions regarding the group understanding that we were not required to peel the tint off on site as the result would likely damage to the window’s internal mechanism and could have the potential to further impair visibility by the remaining glue. We were under the impression based on previous information gained by other members through conversations with local authorities that we were able to take a fine/ticket and then arrive and prove at a later date that the tint had been removed.

Finally once 2 other officers arrived on site, Cst. Kyllio instructed us to talk to the other officer stating “I don’t have time to deal with this” It was at this time that I would like to thank the other peace officer for taking the time to actually explain why we were receiving the tickets and clarify what our options were and what was taking place.

Again during this time frame both the second officer as well as the RCMP officer who had arrived (and parked in the exact same position as we were parked – thus also being illegally parked as well) commented that Cst. Kyllio’s actions were excessive and he was being unfair but as he was the officer on scene first they were unable to over ride his actions and if it had been up to them they would have issued the parking ticket and asked us to leave, which we were very willing to do – however again we were not given that opportunity / chance.

The entire time that this fiasco was taking place several other vehicles all with illegal tint parked around us, or were there prior to our arrival, in addition to 2 other trucks who had parked illegally across several stalls and again I stress no tickets were issued to these other vehicles neither prior no after our incident with the constable. Several of the other cars that were guilty of similar infractions were of higher “quality” cars (IE a lexus, corvette and 2 mustangs) and none of these were ticketed nor the owners confronted when the stood by watching as Cst. Kyllio humiliated our members.

The officer mentioned during his curtness that they had also received a report that 2 black “sporty” cars had been “stunting” on 50th Ave. When I inquired where this avenue is I was told it was several blocks from where we were, this was an impossibility as when we arrived in town we proceeded to the carwash off the main street then proceed down the main street and parked. When we were confronted with this information we felt profiled and targeted simply because of the number of cars and fact that all our cars were “sporty” in nature.

This is the ultimate underlying concern of my letter today – the fact that the responding officer received a complaint of 2 black sports cars “stunting” – no license plates nor further descriptions were given and upon his own investigation Cst. Kyllio noted our cars parked in a row arrived at the assumption that we must have been those culprits and subsequently treated us in a manner that I would not even expect from a parent disciplining their child.

An hour and half after I first confronted the constable we were finally allowed to move our vehicles once the tint was manually removed and he had completed thoroughly humiliated all of our members. We subsequently left the township and proceeded to Red Deer to salvage what was left of our day trip.

This type of action is of grave concern to our members and myself as we feel we were singled out, targeted and subsequently humiliated by Cst. Kyllio in a manner that was uncalled for and very unbecoming of any officer whom is supposed to represent the provincial authority and uphold the law.

We fully understand the need for today’s police to be skeptical of modified cars however at what point does this type of action cross the line and become profiling in nature. We maintain that we are simple car enthusiasts out for a day trip, scoping a very attractive location for a future car enthusiast meet and with the intention of bringing further tourism dollars to a provincial hot spot that ultimately thrives on the spring and summer traffic for a large amount of its annual income.

Other members since have since consulted with various other car enthusiast clubs and are of the same opinion that this type of actions by authorities must be quelled; several other enthusiasts have had similar situations arise from simply being a fan of their cars and wanting to take pride in their possessions. This type of stereotyping is uncalled for as it’s unfair and ultimately against the rights and freedoms that these law enforcement officers have sworn to uphold.

In closing I would like to stress that Cst. Kyllio’s actions while warranted with respect to the infractions were uncalled for in his harassing, humiliating and ultimately tactless approach of how he handled the situation and as a result both myself and fellow members have and are continuing to make every effort to bring awareness to this treatment. We have been in contact with several local news authorities and have been asked to provide statements and photographs of the incident and it is my hope that this information will have a negative impact on the future tourism of this municipality as many other enthusiasts regularly visit this “Albertan Hotspot” and if they are aware of the type of treatment they can expect from the local authorities it is my hope it curbs their enthusiasm to visit.

Thank you for your time and I hope there will be sufficient actions taken as a result of this unfortunate situation.

incredible letter, i will get mine done tonight. i called today to leave a formal complaint with the police and she asked right off the bat if i was with the car club from sunday, lol.
our officer also seems to have gone on holidays the day after so the reports will not be handled till next week, when those who called should recieve a call back form the police station regarding our incident. i was told i would recieve a call anyways.

and on a lighter note: where are the videos of the drive by on the highway? those looked good, get those up asap. lol
also gettign my windows redone tomrrow afternoon. WOOT WOOT!
heading out to peel glue..... ya what fun!!! <- slight sarcastic voice....

I have some photo and the flyby vid it is not the greatest but it works. Can I send thes pics to someone to post as I am not sure how to do it.

In Canada....................if the parking ticket is not properly affixed to the car you can get in it and drive away and that ticket they are working on is not valid. I've done this in downtown Toronto canada with the cop still writing the ticket. I even drove around and re-parked in a different position and then walked to the cop and asked if what I had done was ok!!!!! He said, yes it was.........I never got the ticket. That cop asked you to stay and all of you did. You should have got in the car and drove away.

If I were you guys I would find out where he works and park there often legally and push his buttons. then go around town and park legally, drive legally and just keep him in touch with reality that he treated you guys unjustly.

good luck with what ever you guys do. just think it through and get some advice from a legal authority or if there is a family member that knows a police or rcmp or lawyer with experience with traffic tickets. we have a legal service called POINTS here. never used them but they may be of assistance to you.

We have POINTS here to but they are Insanely expensive. The tickets were not all that expensive $57. We just want to know why we got singled out when there were clearly other vehicles in the visinity of with simmilar infractions that did not get ticketed and to bring awareness to the double standard for young tuners verses an old gent driving a hot rod.

HEY Guys sorry I've left messages with the Herald and haven't heard anything back as of yet from the other news agencies... I think because the Cop is on vacation it will be on hyiatus till hes back and they can interview him and confirm stuff since they dont want to be nailed for slander etc.
